Should my brother file for bankruptcy?
I just want know of a good bankruptcy lawyer in NJ. My brother through out last year has been dawning in credit card/.medical debt. The medical debt is due to my nephew, who was born not so healthy and had to get many surgeries and so much attention from different doctors at Children s hospital of Philadelphia (CHOPS). As of right now he is not delinquent on any credit cards, but I fear that soon he will. I am just trying to fine options for my brother. What can be his best alternative.

Only a bankruptcy attorney can give you the correct answer. The first consultation is FREE and they know what the court will and will not accept as a bankruptcy.
Take all the bills, pay stubs, checking account statements (even if the balance is zero) and let the attorney’s office analyze the situation.
You now have to meet minimum requirements to file bankruptcy, and the attorney can tell him if he meets those or not. If he does, then the bankruptcy is almost always the best choice unless he thinks he’s getting a windfall profit in the near future.
I know many people who would otherwise have lost everything they owned if they had not taken this step. If his debt to earnings ratio is not high enough, then he cannot win a bankruptcy case and the attorney is the one to tell him that.
Check the yellow pages. Look for an attorney who has been around a while. They usually work the payments into the bankruptcy for you too so you only need $1,500 or so up front to start the process IF that’s what they recommend.

how much should a bankruptcy lawyer cost?
I live in NJ and I’m looking for a bankruptcy lawyer, so far I only got one quote and they told me they charge $3000. I feel that that is a little high, especially since I’m trying to file because I have no money for the bills so where am I suppose to get 3000 dollars. Does anybody know a lawyer either in the NYC area or in North Jersey that charges something reasonable?

I have sent you a link to the New Jersey Bar Association, they have a lawyer referral section as well as you can surf the site to see what attorneys in your area handle bankruptcies. You don’t say what chapter bankruptcy you were quoted for. Was this a chapter 13?? If so, that’s a pretty close amount to file. As far as coming up with that amount of money, you can get in to see most bankruptcy attorney’s on a free consultation, after they review your bills and what you will include in a filing, they can tell you what you can stop paying to come up with the retainer fee….been there, done that, seen it happen. I used my tax money and filed 2 years ago…Good Luck!

Filing for Chapter 7 is a process that will take 3-6 months to complete.
Consult with local BK attorneys about your being out of state…they can give the best advice about whether it’s okay to be out of state or to file in NJ.
It might best to stay in FL until the process is finished.
